Requesting that the Joint Committee on Government and Finance
authorize a study of the powers and duties regarding real
estate acquisition and services for real estate held by the
State of West Virginia.
Whereas, The Public Land Corporation was established by an act
of the Legislature in 1989, and was charged with holding title to
all public lands within the State of West Virginia; and
Whereas, The Real Estate Division within the Department of
Administration was established by an act of the Legislature in
2007, and was charged with providing leasing, appraisal and other
real estate services to the Secretary of the Department of
Administration; and
Whereas, Various legislative proposals have been introduced
that would expand the powers of the Real Estate Division both as to
the powers now held by the Public Land Corporation and as to the
units of government over which the Department of Administration now
has jurisdiction; and
Whereas, The Legislature recognizes the need to give careful
consideration to the powers given to the various units of government and to which units of government that certain laws
should apply; therefore, be it
Resolved by the Legislature of West Virginia:
That the Joint Committee on Government and Finance is hereby
requested to authorize a study of the powers and duties regarding
real estate acquisition and services for real estate held by the
State of West Virginia; and, be it
Further Resolved, That the Joint Committee on Government and
Finance report to the Regular Session of the Legislature, 2011, on
its findings, conclusions and recommendations, together with drafts
of any legislation necessary to effectuate its recommendations;
and, be it
Further Resolved, That the Legislative expenses necessary to
conduct this study, to prepare a report and to draft necessary
legislation be paid from legislative appropriations to the Joint
Committee on Government and Finance.
